Charity or fundraising listings policy

eBay encourages community members to be active in supporting charitable endeavours. eBay permits sellers to list items on eBay and collect proceeds (in whole or in part) on behalf of a charity as long as the listings comply with applicable laws and regulations.

In Malaysia, fundraising may only be conducted on behalf of recognised charities, and all members are required to obtain approval from the relevant ministry or government body in order to conduct or participate in any fundraising appeal. Please see the Additional Information section for more detailed information of such regulations.

Guidelines for Fundraising on behalf of charitable organisations

  1. Depending on the objective of the charity or fundraising, approval needs to be obtained from the relevant ministry or government department. For example, if the charity is welfare related, sellers need to seek approval from Jabatan Kebajikan Masyarakat Malaysia.
  2. It will also be illegal for a professional fund-raiser to solicit money or other property for the benefit of a charitable institution, or for a commercial participator to represent that charitable contributions are for the benefit of a charitable institution, unless it is done so in accordance with an agreement with the institution satisfying the prescribed requirements.

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.

Why does eBay have this policy?

eBay urges its sellers and buyers to comply with all governmental laws and regulations. Given that charitable fundraising is a regulated area, sellers are required to comply with all applicable laws before listing them on eBay.
