  So after getting the wrong figure I was able to get a refund and the proper item. How ever this item was not new as the zip tie holding the figure was cut and the figure was dirty. The seller claims that the figure is new.

  I made an honest mistake and quickly corrected it by issuing a refund, covering return shipping, and sending the correct item at no cost. The item was new as described, and any minor storage wear (like a loose zip tie) is expected for a 5-year-old item.
