4. Widerrufsrecht

4.1 Bei einem Kaufvertrag über Waren, die der Kunde über das Internet oder unter Zuhilfenahme sonstiger Fernkommunikationsmittel erworben hat, kann der Kunde – sofern er Verbraucher im Sinne von § 13 BGB ist – ohne Angabe von Gründen innerhalb von 14 Tagen seine auf den Vertragsschluss gerichtete Willenserklärung widerrufen und damit vom Vertrag zurücktreten. Das Widerrufsrecht wird nur dann wirksam ausgeübt, wenn der Kunde innerhalb der vierzehntägigen Frist Foto Presto in schriftlicher Form (Brief oder E-Mail) anschreibt und verlangt, die Ware zurückzunehmen, wobei es genügt, wenn das Rücknahmeverlangen innerhalb der Frist vom Kunden abgesendet wird. Die Frist beginnt frühestens mit Erhalt der Ware und dieser Belehrung. Ist der Kunde Unternehmer, ist ein Widerrufsrecht nach den Vorschriften des Fernabsatzrechts grundsätzlich ausgeschlossen.

4.2 Nach Eingang des Rücknahmeverlangens wird Foto Presto dem Kunden unverzüglich mitteilen, ob Foto Presto die Ware beim Kunden abholen lässt oder ob der Kunde die Ware an Foto Presto zurücksenden soll. Bei einer Rücksendung durch den Kunden erhält dieser auch die Mitteilung über die vorzunehmende Versandart.

4.3 Die Kosten für eine Rücksendung der Ware aufgrund eines Rücknahmeverlangens trägt der Kunde bei einem Warenwert bis zu EUR 40,00. Bei einem Warenwert über EUR 40,00 trägt grundsätzlich Foto Presto die Kosten der Rücksendung. Mehrkosten, die dadurch entstehen, dass der Kunde entgegen der Mitteilung von Foto Presto gemäß Ziffer 4.2 einen anderen, teureren Versandweg wählt, werden von Foto Presto nicht erstattet.

4.4 Die Ware einschließlich ihrer Verpackung und sämtlicher Zubehörteile ist in einwandfreiem und unversehrtem Zustand zurückzugeben. Eine Rücknahme der Ware ist ausgeschlossen, wenn sich die Ware in einem solchen Zustand befindet, dass ein weiterer Verkauf der Ware unmöglich ist. Bei sonstiger Verschlechterung der Ware ist Foto Presto berechtigt, Wertersatz zu verlangen, der sich nach dem Minderwert der Ware richtet und im Einzelfall zu ermitteln ist. Ein Wertersatz kommt nicht in Betracht, wenn die Verschlechterung der Ware ausschließlich auf deren Prüfung – wie sie dem Kunden im Ladengeschäft möglich gewesen wäre - zurückzuführen ist. Im übrigen kann der Kunde die Wertersatzpflicht vermeiden, indem er die Ware nicht wie ein Eigentümer in Gebrauch nimmt und alles unterlässt, was deren Wert beeinträchtigt.

4.5 Eine Rücknahme ist ferner ausgeschlossen bei Video - oder Audioaufzeichnungen, deren Versiegelung geöffnet wurde, bei Studiohintergründen, bei Zeitschriften, Zeitungen, Broschüren, Katalogen und Illustrierten.
