So sorry to be blunt, but this must be user error as the item was new/factory sealed. It may also be factory error which would be rare, but there was no incorrect advertisement on my end as the item was factory sealed. I would instruct the gift recipient to contact the manufacturer or possibly troubleshoot the issue with JBL support.
