Animals and wildlife products policy

• Live animals - Live animals and pets are not allowed to be listed on eBay.
• Stuffed Birds - Stuffed native or migratory birds and such other protected species, any part of any native or migratory bird or protected species, or any native or migratory bird or other protected species nest or egg may not be listed on eBay.
• Stuffed non-native, non-migratory birds, or parts of such birds may be listed on eBay if not in violation of the sellers' specific local laws.
• Animal Pelts - Animal parts, including pelts from endangered species may not be listed on eBay. Animal pelts from non-endangered species may generally be listed on eBay, if not in violation of the seller's specific local laws.
• Other Animal Products - Endangered or protected species, alive or dead, or any parts, products or derivatives of any endangered or protected species may not be listed on eBay. Wildlife parts and related products include ivory, skin, horn, bone, shell, scale, tooth, trophy, skeleton, egg, meat, musk, gall bladder, medicinal products containing endangered species (e.g. rhinoceros horn, tiger bone, musk, etc), wildlife souvenirs, wood chips, roots, bulbs, seedlings and many others.

  It is an offence in Malaysia to sell, offer for sale, or trade in such endangered species. Recent amendments to the law have significantly increased penalties imposed for such offences, and sellers are strictly prohibited from listing such species on eBay.
• Bear Products - Bears and bear products (eg: bear teeth, claws and rugs) may not be listed on eBay.
• Rhino horns - Rhino horns and rhino horn products may not be listed on eBay.
• Ivory - Ivory and ivory products may not be listed on eBay.
• Internal organs - Internal organs of animals (eg: bear gall bladders) may not be listed on eBay.
• Skins, hides and rugs - Generally such items may be listed on eBay, subject to the above limitations.
• Products made from "tortoise shell" or other turtle products - There are a number of items that have been made, both lawfully and unlawfully, from the shell of the hawksbill turtle, a sea turtle that is now an endangered species protected by international law.
• eBay will not permit the sale of any item made, in whole or part, from any part of a sea turtle. This includes items such as guitar picks, jewellery, jewellery boxes, hair combs, and other products made from the shell of the hawksbill turtle. Items that appear from the listing to be made from "genuine" tortoise shell are not permitted. eBay realises that users commonly use the phrase "tortoise shell" to describe items that have a particular design resembling a tortoise shell, and that many "tortoise shell" products are actually made out of plastic, glass or a composite material. These items are permitted on eBay. However, to avoid confusion, listings of such "faux" tortoise shell items should clearly state that the item is not made of "genuine" tortoise shell.
• Marine Mammals - Marine mammal products, including but not limited to Polar Bear, Sea Otter, Whales and Orca (Baleen & Ivory), Porpoise, Dolphins, Seals, generally may not be listed for sale.

• For additional specific questions about migratory birds, endangered species, or other questionable items in this area, you should contact the Secretary General of the Ministry of Natural Resources and Environment (NRE), Forestry Development Division, Level 12, Tower Block, Lot 4G3, Precint 4, Federal Government Administrative Centre 62574 Putrajaya, the Department of Veterinary Services ("DVS") of the Ministry of Agriculture and Agro-based Industry. and the Ministry of Natural Resources and Environment. The DVS is responsible for issuing permits or licences for importing or exporting animals or birds into or from Malaysia. Licences for importation of plants and plant products are issued by the Department of Agriculture of the Ministry of Agriculture and Agro-based Industry and licences for importation and exportation of fishes are issued by the Fisheries Department of the Ministry of Agriculture and Agro-based Industry.

  • Animals and Birds: The import or export of an animal, bird or their parts into or from Malaysia requires a permit from DVS. DVS import permits must be obtained prior to the arrival of the consignments. For protected wild birds and animals, licences for importation and exportation will have to be obtained from the Ministry of Natural Resource and Environment.   • Plant and Plant Products: The Department of Agriculture of the Ministry of Agriculture and Agro-based Industry is the responsible authority. Import permits are required in respect of items such as potted plants, plants of coffee, soil and organic manures, as well as insects and micro-organisms.   • Ornamental Fish: The import and export of ornamental fish requires a licence from Crops, Livestock and Fishery Industry Division, Fisheries Department of the Ministry of Agriculture and Agro-based Industry. However, the import of piranha and piranha-like fish are strictly prohibited, and the import of Dragon Fish must be reported and inspected by Fisheries Department of the Ministry of Agriculture and Agro-based Industry. • CITES: The Convention and International Trade in Endangered Species of Wild Fauna and Flora (CITES) is an international agreement which seeks to ensure that trade does not threaten wildlife species with extinction. CITES regulates international trade in certain highly endangered or threatened species of live animals and plants, and their parts and derivatives.

  • Permits are required for any consignments to leave or enter a country, and member countries restrict international trade in species listed in Appendix I and by regulating and monitoring trade in others included in Appendix II and III that might become endangered (see CITES species)
  • Malaysia became a signatory to CITES in October 1977 and the Ministry of Natural Resources and Environment is the Management Authority responsible for the implementation and enforcement of CITES in Malaysia. eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since the sale of live animals and wildlife products is in some cases prohibited, highly regulated, or may cause harm to eBay or its members, sellers are restricted in their listing of them on eBay.
