Examples of hazardous materials and their related exclusions (if any):

Under the Chemical Weapons Convention Act 2005, it is an offence to produce, acquire, retain, transfer or use toxic chemicals listed under the Schedules of the Act without authorisation by the National Authority. The Poisons Act 1952 also regulates the sale of poisons in Malaysia and the list of poisons may be found in the Schedules of the Act. The Customs (Prohibition of Imports) Order 1998 and Customs (Prohibition of Exports) Order 1998 also lists poisonous chemicals that are absolutely prohibited, toxic chemicals and their precursors and toxic and/or hazardous wastes where a letter of approval and/or licence is required by the relevant Ministry.

• Fireworks: Dangerous fireworks may not be listed on eBay. Under Malaysian law, it is an offence to sell, transport, send, deliver, distribute or import fireworks, and postal regulations prohibit posting these items through the postal system. • Radioactive Substances and Irradiating Apparatus: Under Malaysian law, it is an offence to sell, deal with, import or export any radioactive substances or irradiating apparatus without approval from the Atomic Energy Licensing Board. Irradiating apparatus below 5keV is exempted as long as the apparatus acquired the maximum energy which is capable of emitting or producing radiation not exceeding 5keV, the apparatus is purchased from a seller who is licensed by the Board and the person ensures that the apparatus can no longer function before he disposes of it. Any low activity radioactive material is also exempted provided that the activity concentration per unit weight (Bg/gm) of the low activity radioactive material does not exceed the value as specified in the Atomic Energy Licensing (Exemption) (Low Activity Radioactive Material) Order 2002 and that the total effective does to the public is less than 10 microsieverts per year. • Postal Service Prohibited and Restricted Items: Items such as firearms, explosive or flammable substances, controlled drugs, and poisons are prohibited from being posted, conveyed or delivered by post under the Postal Services Act 1991. Items restricted by Pos Malaysia generally do not pose a danger to health, safety, or property while being transported, but their transport is regulated or banned for public policy reasons. Under Malaysian law, items such as radioactive substances and perishable biological substances exchanged between officially recognised or qualified laboratories are restricted and may only be posted if packed in accordance with certain stipulated conditions. Generally, restricted items that may be lawfully transported by mail or common carrier are permitted on eBay, unless otherwise prohibited by eBay rules. Examples of restricted items that may be listed on eBay include insects such as honeybees or ladybugs, and some knives.
