Firearms, weapons, and knives policy

Most weapons can't be listed on eBay because of strict laws banning the sale of these items. To safeguard the community, we may also ban other related items that are legal to sell outside of eBay.

Policy overview

Listings of permitted weapons must comply with the Arms Act 1960, Corrosive and Explosive Substances and Offensive Weapons Act 1958 and Explosives Act 1957. It is an offence for any person to sell or offer for sale any of the weapons listed in the Second Schedule of the Corrosive and Explosive Substances and Offensive Weapons Act 1958.  In addition, listings must follow our guidelines as well as meet the following requirements:

  • The seller is located in Malaysia;
  • The buyer is located in Malaysia;
  • The item is also in Malaysia;
  • Both the seller and buyer are licensed to purchase and possess the permitted item (if necessary under local laws); and
  • The seller offers only domestic shipping for the item, since international shipping would make the item available in countries where it might be prohibited.

Activity on eBay is required to:

  • Follow all applicable laws
  • Respect the rights of third parties
  • Follow the eBay User Agreement
  • Follow this eBay policy

If activity doesn't meet these requirements, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: administratively ending listings or cancelling transactions, hiding or lowering the placement of listings in search results, lowering seller rating, restricting buying or selling, forfeiture of fees, loss of buyer or seller protections, restricting access to member communication and rating tools, removing feedback, and account suspension.

Additional information

Before posting any military items on eBay, check the information contained in Part 121 of the International Trade in Arms Regulations (ITAR) - opens in new window or tab. This law restricts the export and import of certain military items and information. In addition to other regulations and restrictions, for the items and information listed in Part 121, ITAR also requires sellers who intend to ship these items to outside the United States to obtain a special license from the U.S. Department of State - opens in new window or tab.

Since we cannot determine whether the seller has a license, the seller can only sell items to U.S. citizens currently living in the U.S. You must specify in your listing that only local delivery is allowed, and ensure that you and the buyer comply with all applicable laws and regulations, as well as eBay policies.

The items and information that are permitted by eBay but listed in Part 121 can only be published on eBay's US website (eBay.com) by sellers registered in the United States, and only for local delivery (within the United States). In any case, the items listed in Part 121 of ITAR cannot be published on other eBay websites.

Why does eBay have this policy?

For safety reasons and to comply with laws and regulations, we restrict the weapons and accessories that can be sold on eBay. Please ensure that you comply with all laws and regulations and comply with eBay policies before buying or selling these items.
